JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-10-2025 Heard Mr. Hemant Kumar Karan, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, informant, namely Ram Shogarat Yadav, alleged that on 26.07.2025 at about 6:30 PM, when he was returning from Garhpura Bazar and reached near Singhania Dharmsala, in the meantime, one unidentified person came on a Scorpio vehicle bearing Registration No. BR01FZ8178 and assaulted on the head of informant by means

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in this case during course of investigation merely on the basis of confessional statement of co-accused person in which it is stated that this petitioner is driver and owner of the said Scorpio vehicle. During investigation, none of the witnesses have claimed to have seen this petitioner committing the alleged offence and he has been made an accused in this case merely because he happens to be owner of the vehicle in question. As a matter of fact, on the alleged date and time of occurrence, this petitioner was not present at the place of occurrence. Injuries sustained by the injured are simple in nature.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and nature of injuries sustained by the injured, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C.-cum-A.M., Begusarai in connection with Garhpura P.S. Case No. 84 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
