JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Motihari Town P.S. Case No. 775 of 2016 instituted for the offence under Sections-457, 380 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner has clean antecedent and he is in custody since 0112-2016. It is alleged in the written report that various articles have been stolen from the official quarter of the informant in between 24-11-2016 to 27-11-2016. It is also mentioned in the written report that Dayanand Kumar used to stay in the quarter and look after the same. He informed about the theft to the informant. Seven items, mentioned in the written report, are alleged to have
Patna High Court Cr.Misc. No.24302 of 2017 (2) dt.24-05-2017 2/2 been stolen. As per seizure list, one inverter of Microtec and one LCD of Samsung are alleged to have been recovered. The informant has not given the brand name of the theft articles in the written report.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Town P.S. Case No. 775 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran subject to condition that both the bailors should be close relatives of the petitioner.
