The petitioner seeks bail in Paliganj P. S. Case No. 131 of 2015 instituted for the offence under Section(s) 419, 420, 406, 409 and 120B of the Indian Penal Code. The petitioner is in custody since 21.9.2016. Learned counsel for the petitioner has submitted that petitioner is Treasury Messenger. It has further been submitted that there is no specific allegation against this petitioner. The informant has alleged that she is working as A.N.M. in Primary Health Centre. She learnt that an amount of Rs. Nine lakhs has illegally been withdrawn from her GPF Account.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.49997 of 2018(3) dt.12-10-2018 2/2 petitioner is only a Treasury Messenger and not the Drawing Disbursing officer, who is competent authority to withdraw the money. It has further been submitted that other co accused persons have been granted regular bail by coordinate Bench of this Court in Cr. Misc. no. 49049 of 2016 and Cr. Misc. no. 12860 of 2017 by order dated 21.12.2016 and 10.5.2017 respectively.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Danapur, Patna, in connection with Paliganj P. S. Case No. 131 of 2015 subject to the condition that both the bailers shall be the close relative of the petitioner.
