Learned counsel appearing on behalf of the petitioner submits that the petitioners and others had applied for the post of Aagan Bari Sevika in the block Sahiyara Ward No. 7, Aganwari Center No. 222, district Sitamarhi, while the petitioner was fittest candidate for appointment, but, her name was not considered in the general meeting of Aam Sabha, held on 07.03.2019. The petitioner has filed the application before the District Programme Officer, Sitamarhi, on 31.05.2019, but, the same is still pending for disposal.

According to the guidelines, issued by the Additional Chief Secretary, Welfare Department, Government of Bihar, in

Patna High Court CWJC No.21466 of 2019(2) dt.02-12-2019 2/2 the year 2019, regarding the selection of Aagan Bari Sevika/Sahayika, under clause 11 any person aggrieved with the selection of Aagan Bari Sevika shall file the complaint before the Child Development Project Officer within 30 days of meeting of the Committee with evidence and supported affidavit, who shall pass the speaking order, hence, the petitioner has the remedy to file the complaint before the Child Development Project Officer, Sahiyara, Sitamarhi, respondent no. 3.

With the above observation, the petitioner is directed to file the complaint within two weeks, from the date of passing of this order, before respondent no. 3, who shall, in accordance with Clause 11 of the Guidelines, pass reasoned order within thirty days of receiving the complaint.
