====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 20-07-2017 It is indicated in Letter No. 125 dated 17th of April, 2017 of the 6th Addl. Sessions Judge Saran that Rail Siwan P.S. Case No. 19/17 dated 29.3.2017, G.R. No. 2268 of 2017 has been instituted by the informant who is Police Sub Inspector Rail P.S. Siwan, Camp Siwan Rail Station Platform against the accused person under Section 30(a) of Bihar Prohibition and Excise Act, 2016. However, as the case related to Police Station Rail Siwan, Rail Sub Division Sonepur, District- Rail Muzaffarpur, the case was inadvertently received by the court in question under Saran Session Division. It is indicated in the letter that as the place of occurrence of the above case is situated in Siwan Railway Station, which comes under the territorial jurisdiction of Special Court, Excise of Siwan Session Division, therefore, a prayer is made for transfer of the aforesaid case record from Chapra to the court of Special Excise, Siwan Session Division.

Patna High Court MJC No.1970 of 2017 (2) dt.20-07-2017 2/2 Keeping in view the aforesaid communication received from the Additional Sessions Judge-VI, Saran, the application is allowed. The case record be transferred to the Court of Special Excise Siwan Session Division. The matter be placed before the concerned District & Sessions Judge for assigning it to the Special Court in question.
