JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2018 Petitioner seeks bail in Kotwali P.S.Case No.451 of 2017 registered for the offence under Sections 302, 307/34 of Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of firing on the deceased causing his death and post mortem report also shows that death was due to hemorrhage, shock and injury to vital organ Heard the parties.

as a result of aforementioned injuries caused by fire arm. Submission of the learned counsel for the petitioner is that there is case and counter case. Further submission is that the informant along with others entered inside the house and tried to misbehave with the daughters of the petitioner and also assaulted her with bhala causing injury at her chest which was recovered. The petitioner is in custody since 17.12.2017.

Patna High Court Cr.Misc. No.45764 of 2018 (3) dt.11-09-2018 2/2 Heard the learned A.P.P. also who opposed the prayer for bail of the petitioner stating that the trial has commenced and only I.O. has to be examined.

Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected.

However, the learned trial court is directed to expedite the trial and conclude it within a reasonable time. This application is dismissed.
