2. The petitioner has prayed for bail in a case registered for the offence punishable under sections302, 201/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per allegation in the FIR, elder brother of the informant, namely, Azim (deceased) is an E. Ricksaw driver. On 4.7.2021 he left his house to run his E. rickshaw and did not return till night. On next day his dead boy was found with fire arm injury at Rahikpur and his E. Ricksaw was found missing.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case on mere suspicion. He is not named in the FIR. Petitioner was remanded in the present case from Tarabari P.S. Case No. 84 of
Patna High Court CR. MISC. No. 3912 of 2023(3) dt.07-08-2023 2/2 2021. No one is the eye witness of the alleged occurrence. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 29.09.2022 passed in Cr. Misc. No. 25042 of 2022. Petitioner is languishing in judicial custody since 28.07.2022..
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Araria (RS) P.S. Case No. 556 of 2021.
