JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Malsalami P.S. Case No. 46 of 2018 registered for the office under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner, who happens to be the husband of the deceased, is of causing the death of his wife. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of suspicion and nothing incriminating has been recovered from the possession of the petitioner. It is also submitted that there is no eye witness of the occurrence and they have been made accused on the basis of suspicion and the petitioner is in custody since 12.02.2018.
Patna High Court Cr.Misc. No.44711 of 2018 (3) dt.05-09-2018 2/2 Heard learned A.P.P., who opposed the prayer for bail stating that the petitioner, who is husband of the deceased and was died in the house of the petitioner.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner rather, the trial Court is directed to expedite the trial and conclude preferably within six months from production of a copy of this order.
With the aforesaid observation, this application is dismissed.
