ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner, being the husband, is in custody since 25.10.2017 in connection with S.T. No. 361 of 2018 arising out of Paliganj P.S. Case No. 257 of 2017 for the offence registered under Sections 304B, 201/34 of the Indian Penal Code. Considering the fact that petitioner is the husband and he has moral responsibility to ensure the welfare of his wife and the death has occurred within one and half years of her marriage and also because the dead body was surreptitiously cremated at Bas Ghat, Patna without informing the family members of the deceased, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.
Let the trial of the case be completed within a period of six months positively from the date of receipt/production of a copy
Patna High Court Cr.Misc. No.43147 of 2018 (3) dt.21-08-2018 of this order without granting unnecessary adjournments to either of the parties.
