JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner, who is in custody since 25.07.2019 seeks bail in connection with Araria (R.S.) P.S. Case No. 272 of 2018, dated 13.05.2018, instituted for the offences under Section 392 of the Indian Penal Code.

It appears that the petitioner has neither been named in the F.I.R. nor any suspicion has been raised against him. The name of the petitioner has transpired in the confession of one Naiyar Alam.

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and he has also not been put on test identification

Considering the aforestated facts, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P.S. Case No. 272 of 2018. The application stands allowed.
