JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Musarigharari P.S. Case No. 55 of 2021 registered for the offence under Sections 498-A and 304-B read with 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. Allegation against the petitioner is to cause death of daughter of informant alongwith other co-accused persons/family members due to non-fulfillment of demand of dowry as alleged for one motorcycle.
Learned counsel appearing on behalf of petitioner submitted that it is a case of suicide due to family frustration, where petitioner is mother-in-law living separately,
Patna High Court CR. MISC. No.75177 of 2022(2) dt.05-05-2023 2/2 having no connections with daily and domestic affairs of the daughter of informant and her husband. It is submitted that petitioner has been implicated in this case only being the mother-in-law, who is a lady of clean antecedent. Learned APP appearing on behalf of State opposes the prayer for bail.
In view of the above-mentioned facts and circumstances, as petitioner is mother-in-law living separately with deceased and her husband accordingly, in the event of her arrest or surrender in the court below within a period of four weeks, she is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Class 1, Samastipur/concerned Court in connection with Musarigharari P.S. Case No.55 of 2021 subject to the conditions as laid down under Section 438(2) of the CrPC. (Chandra Shekhar Jha, J.) Sanjeet/- U T
