JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 4.8.2017 passed in Cr.Misc.No. 32379 of 2017 and there is allegation of recovery of 10 kg. of ganja. Submission of learned counsel for the petitioner is that petitioner is in custody since 2.2.2017 and as yet trial has not been concluded.

Heard learned APP and from perusal of report it appears that the case is fixed for defence evidence and learned trial court has requested for three months time to conclude the trial. In such view of the matter, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it within a further period of three months and if trial is not concluded within the said period

Patna High Court Cr.Misc. No.45120 of 2018 (3) dt.29-08-2018 2/2 and there is no laches on the part of the petitioner, learned trial court shall release the petitioner on bail to its own satisfaction. With the above observation, this application is disposed of.
