2. The petitioner seeks bail in Routa P.S. case No. 89 of 2023 instituted for the offences under Sections 341, 342, 323, 371, 370(A), 376, 120(B) of the Indian Penal Code and Sections 3, 4, 5, 6 and 9 of Immoral Traffic Act.
3. Prosecution allegation, in short, is that the accused persons including the petitioner were involved in the business of immoral trafficking and were running brothel house. Huge materials relation to immoral trafficking were recovered from the places where the raid was conducted.
4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.06.2023 and has no criminal antecedent. Charge-sheet has been submitted in this case. The
Patna High Court CR. MISC. No.76591 of 2023(2) dt.04-12-2023 2/2 petitioner has falsely been implicated in the present case merely due to malicious motive and high handedness of the police. The statement of arrested victim has been recorded u/s 164 Cr.P.C. wherein the victim girls did not state a single word against the petitioner. Other similarly situated co-accused have already been enlarged on bail vide order dated 11.10.2023 passed in Cr. Misc. No. 64023 of 2023 and order dated 31.10.2023 passed in Cr. Misc. No. 67593 of 2023.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Routa P.S. case No. 89 of 2023.
