The petitioner seeks regular bail in connection with Kotwali (Barari) P.S.Case no.82 of 2018 dated 6.2.2018 (G.R.No.520 of 2018) corresponding to S.T.No.368 of 2018 registered for offences punishable under Sections 504, 506, 34 of the Indian Penal Code and Sections 3/ 4 of the Explosive Substance Act. Allegation against the petitioner as per FIR is that earlier a case of firing was lodged by the informant against the petitioner and the petitioner was threatening to withdraw the case and he exploded bomb in front of his house to terrorize him. It further appears that he is accused in several other cases . Submission of the learned counsel for the petitioner is that earlier Station Case Entry had been filed, where no allegation of explosion is made and moreover, during the investigation also the
Patna High Court Cr.Misc. No.47989 of 2018 (3) dt.27-09-2018 2/2 police Officer has not found any sign of explosion of bomb. The petitioner is in custody since 23.8.2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of ADJ 1st, Bhagalpur in connection with Kotwali (Barari) P.S.Case no.82 of 2018 dated 6.2.2018 (G.R.No.520 of 2018) corresponding to S.T.No.368 of 2018.
With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
(iv) He will not try to harass the informant, otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed. '
