JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Sessions Trial No. 07 of 2015 (arising out of from Sangrampur P.S.Case No. 75 of 2015), registered for the offence under Sections 376 (D), 354 (B) and 506/ 34 of the Indian Penal Code and Sections 4 and 8 of POCSO Act.
Allegation against the petitioner along with other coaccused Pankaj Manjhi of committing rape with the minor informant.
Submission of the learned counsel for the petitioner is that the medical evidence does not support the prosecution version and after completing investigation charge sheet has been submitted under Section 354 (B) and 506 of the Indian Penal Code
Patna High Court Cr.Misc. No.44850 of 2018 (3) dt.06-09-2018 2/2 and Sections 4 and 8 of the POCSO Act and all evidence has been collected by the Investigating officer and there is no chance for tampering with the evidence and the petitioner has no criminal antecedent.
Heard learned A.P.P. also who opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody since 06.07.2015, the trial court is directed to expedite the trial. With the aforesaid observation, this application is dismissed.
