JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioners seeks bail in anticipation of his arrest in connection with Bihpur (Jhandapur) P.S. Case No. 263 of 2019, registered for the offences punishable under Sections 20, 22 of N.D.P.S. Act.

As per F.I.R there is recovery of 250 gm. Ganja were recovered from the betel shop of the petitioner. Submission of the learned counsel for the petitioner is that both father and son are made accused in this case and father was already arrested by the police. Moreover, small quantity of Ganja was recovered in this case. On the other hand, learned A.P.P. has opposed the prayer of bail.

Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of

Patna High Court CR. MISC. No.68580 of 2019(2) dt.25-10-2019 2/2 anticipatory bail to the petitioners, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on its own merit without being prejudiced by dismissal of this order possible on the same day.
