2. Petitioner is in custody in a case registered for the offences punishable under Sections 317(2), 317(4), 317(5), and 3/5 of the BNS, 2023.

3. As per allegation in the FIR, the petitioner along with other co-accused persons used to snatch mobile phones of the people walking on the streets and later sell them. It is also alleged that an iron knife has also been recovered from the right pocket of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to dirty village politics. He next submits that nothing has been recovered

Patna High Court CR. MISC. No.75108 of 2025(3) dt.10-12-2025 2/2 from the conscious possession of the present petitioner. He next submits that the petitioner is not a part of any robbery group and he is only a sound operator in an Orchestra. He next submits that there is no independent witness in this case except the Chaukidars. He next submits that name of the petitioner has been transpired in this case on the basis of confessional statement of co-accused person, namely, Gabbu Miya. The Petitioner is in custody since 10.12.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and submission of the learned counsel of the petitioner, so let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to be satisfaction of learned Judicial Magistrate 1st Class, Gopalganj/concerned Court in connection with Vijayipur P.S. Case No. 276 of 2024.
