JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-09-2018 The petitioner who is the husband of the deceased seeks his bail in connection with Sessions Trial No. 269 of 2016 arising out of Marhowrah P.S. Case No. 415 of 2015, which was initially instituted for the offences under Sections 498-A and 307 of the I.P.C., but Section 302 was also added later.
The prayer for bail of the petitioner was earlier rejected on 29.11.2017. On that occasion, this Court had noted down that out of 12 cited prosecution witnesses, 5 had already been examined. The trial court had sent a report that the remaining 7 witnesses were likely to be examined within a period of six months. Learned counsel appearing for the petitioner has informed this Court that 9 witnesses, up till now, have been examined and 3 more are yet to be

The petitioner has remained in jail since 16.12.2015.
Regard being had to the aforesaid facts, the trial court is directed to conclude the trial positively within a reasonable period, preferably within a period of four months from today.
With the aforesaid direction, this bail petition stands disposed off.
