JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajpur P.S. Case No. 131 of 2019, (NDPS No. 05 of 2019) registered for the offences punishable under Sections 20 (i) (b)/ 22 (e) of N.D.P.S. Act.
As per F.I.R. there is recovery of 14.320 Kg of Ganja from the house of the petitioner.
Submission of the learned counsel for the petitioner is that it is a joint house and he has falsely been implicated in this case.
Learned A.P.P has opposed the bail prayer of the petitioner on the ground that there is recovery of Ganja from the house of the petitioner which is more than the small quantities and petitioner has accused in one more case of Excise Act.
Patna High Court CR. MISC. No.68927 of 2019(2) dt.18-11-2019 2/2 Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly bail prayer of petitioner is dismissed.
