15-09-2017 Heard Sri Ashok Kumar Singh, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 30-05-2017 in Badem O.P. (Nabinagar) P.S. Case No. 95 of 2017 registered for offence under Sections 30(a), 38 of Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail. By way of referring to statement made in paragraph - 3 of the petition, learned counsel for the petitioner submits that petitioner is having clean antecedent and in the present case, the petitioner has been made accused only on the ground that he was owner of a vehicle, from which, huge quantity of countrymade liquor was recovered. He submits that the vehicle, at the time of seizure, was being driven by one Sandip Kumar, who
Patna High Court Cr.Misc. No.41687 of 2017(2) dt.15-09-2017 2/2 has already been granted bail.
Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Ajit Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - VII cum Special Judge, Aurangabad in connection with Badem O.P. (Nabinagar) P.S. Case No. 95 of 2017.
