JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner seeks bail in connection with Shahkund P.S. Case No. 61 of 2019 instituted for the offences under Section 394 of the Indian Penal Code. The petitioner is in custody since 19.07.2019 but till date, no Test Identification Parade has been conducted.

The learned counsel for the petitioner has submitted that petitioner has not been named in the F.I.R. He was arrested in another case on suspicion in which he was made to confess his guilt and on the basis of such confession, three other cases have been lodged against him, reference of which has been given in

Patna High Court CR. MISC. No.64857 of 2019(3) dt.04-03-2020 2/2 paragraph 3 of the petition. However, out of those three cases, the petitioner is on bail in two of them. Considering the aforestated facts, specially that the petitioner's implication in this case is only on the basis of suspicion and no Test Identification Parade has been held till date even when the petitioner is in jail for such a long time, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bhagalpur in connection with Shahkund P.S. Case No. 61 of 2019.
