JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Chhote Lal Mishra , learned counsel for the petitioner and learned Additional Public Prosecutor . The sole petitioner ,who is in custody since 05.07.2017 in Nauhatta P.S. Case No. 13 of 2017 registered for the offence under Section 272, 373/34 of the Indian Penal Code, 1860 and section 30(a) of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail.
Learned counsel for the petitioner submits that near the road side recovery of huge quantity of country made liquor was shown and petitioner was made accused on the confessional statement of the co-accuseds who were apprehended by the police.
Besides arguing on merit, learned counsel for the petitioner has drawn my attention to the statement made in paragraph no.
Patna High Court Cr.Misc. No.42560 of 2017(2) dt.15-09-2017 2/2 3 of the petition to show that petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner Moua Kumar @ Mouwa Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II, Rohtas ( Sasaram) / concerned court in connection with Nauhatta P.S. Case No. 13 of 2017.
