JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 Petitioner seeks regular bail in connection with Agrer P. S. Case No. 55 of 2019 registered for the offences punishable under Sections 147, 148, 149, 307, 506 of IPC and Section 27 of the Arms Act.

As per prosecution case the informant was heard about firing of five shot. Later on, he saw that his uncle was in injured condition and also one motorcycle was recovered by them. Later on, it transpires that motorcycle belongs to the petitioner.

Submission of the learned counsel for the petitioner is that he is the Gotiya of the informant and as such, his motorcycle was there. There is case and counter case between the parties. The injury is simple in nature. Moreover, he is in custody since 02.08.2019.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Rohtas at Sasaram, in connection with Agrer P. S. Case No. 55 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
