1. Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant.
2. The petitioners have preferred this application for grant of regular bail in connection with Imamganj P.S. Case no. 155 of 2023 registered under sections 304B and 34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that his daughter was married to the son the petitioners herein. The accused persons including the petitioners herein started to torture his daughter for non-fulfillment of the demand of dowry
Patna High Court CR. MISC. No.73749 of 2023(2) dt.29-11-2023 2/3 to the tune of an Apache motorcycle and Rs.4 lacs in cash. The informant states that she was ultimately done to death.
4. Learned Senior counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioners happen to be the mother-in-law and father-in-law of the deceased. Referring to the contents of the postmortem report it is submitted that it is a case of suicide. The petitioners are in custody since 21.7.2023 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioners who happen to be the mother-in-law and father-inlaw of the deceased, the petitioners being in custody since 21.7.2023, charge-sheet having been submitted in the case and the petitioners not having any criminal antecedent, both the petitioners are directed to be enlarged on bail in connection with Imamganj P.S. Case no. 155 of 2023, on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
