Heard learned senior counsel for the petitioner, Sri Krishna Prasad Singh and learned A.P.P. for the State. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code. 3.

Learned senior counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons are fixing pillar on his land, accordingly he reached the place of occurrence when accused persons started abusing and on orders of Md. Sajjad, accused Md. Azad assaulted repeatedly by farsa causing injury on head, thereafter Md. Rajjak assaulted by an iron rod causing fracture of hand and Md. Munna assaulted by dabiya causing

Patna High Court CR. MISC. No.71103 of 2025(2) dt.14-10-2025 2/3 injury on head, further Md. Rajjak caught his son and Md. Sajjad assaulted by sword causing injury on head of his son and Md. Munna snatched Rs.4,000/-, while female accused were present carrying sword.

The learned senior counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner and informant are own brothers and are having dispute relating to property, as would manifest from the allegations as alleged in the FIR. It is further submitted that specific allegation of assaulting the injured causing serious injuries is against Md. Sajjad, Md. Azad and Md. Munna, but since petitioner is own brother of the informant, as such it is alleged that he also assaulted by rod causing injury on hand which is non vital part of the body. It is further submitted that Md. Sajjad assaulted the son of the informant by sword but then it is alleged that petitioner had caught the son of the informant on account to which Md. Sajjad assaulted, the said allegation is ornamental in nature. It is further submitted petitioner will not abscond and is not a criminal and will cooperate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.71103 of 2025(2) dt.14-10-2025 3/3 anticipatory bail of the petitioner.

Considering the submissions made by the learned senior counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chhatapur P.S. Case No. 67 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
