The petitioner seeks bail in connection with Dumariya Ghat P.S. Case No. 98 of 2019, registered under Section 395 of the Indian Penal Code.

The accusation is that the informant while was returning from Motihari, some unknown bike borne accused persons, on the point of pistol, snatched mobile, cash motorcycle and jewellery of his wife.

Submission is that petitioner is not named in the first information report. In course of investigation the name of the petitioner surfaced in the confessional statement of the coaccused, Raushan Yadav, thereafter, the petitioner was apprehended in this case and remanded in two other cases also, as detailed in paragraph 3 of the petition. The petitioner is in

Patna High Court CR. MISC. No.69808 of 2019(2) dt.11-12-2019 2/2 custody since 04.07.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Dumariya Ghat P.S. Case No. 98 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, I, East Champaran, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
