Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code, Sections 3/4/5 of the Explosive Substance Act. The FIR of the occurrence of dacoity is against unknown. Petitioner was remanded in this case from some other case on 01.07.2019.
Submission is that the petitioner has not been put on T.I. Parade. Investigation of the case is already complete. Nothing incriminating was recovered from possession of the petitioner.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.65599 of 2019(2) dt.04-11-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Pothia Police Station Case No. 10 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
