2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 376, 420, 323, 504, 307, 364 and 34 of the Indian Penal Code; Section 27 of the Arms Act and Sections 4 and 6 of the POCSO Act.

3. As per the prosecution case, this petitioner, along with other co-accused persons, is alleged to have kidnapped the informant and committed rape on the pretext of marriage.

4. It is submitted by learned counsel for the petitioner that specific accusation of commission of rape is against coaccused Abhishek Patel @ Boston. This petitioner is only alleged to have accompanied other co-accused persons in taking away the informant to the railway station. There is no specific allegation of any overt act against this petitioner. Petitioner

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeVI (Six)-cum-Special Judge, POCSO, Bihar Sharif at Nalanda, in connection with Mahila P.S. Case No.70 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
