The petitioner seeks bail in connection with Bihiya P.S. Case No. 309 of 2019, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of Arms Act. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that from perusal of FIR and seizure list, it appears that nothing has been recovered from the conscious possession of the petitioner except one live cartridge. The petitioner has no criminal antecedent and he is in custody since 18.08.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

Case No. 309 of 2019.
