2. The petitioner seeks regular bail in a case registered for the offence under Sections 392 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of committing loot of money, motorcycle and mobile phone.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 03.07.2023 he is quite innocent

5. Learned counsel for the petitioner undertakes that the petitioner will pay an amount of Rs. 30,000/- to the informant without prejudice to his case and without accepting his guilt.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bai on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd A.C.J.M., Muzaffarpur/concerned Court below in connection with Motipur P.S. Case No. 304 of 2022 subject to condition that:- 8(i) The petitioner will mark his attendance at the Sahebganj Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

No.74021 of 2023(2) dt.29-11-2023 3/3 8 (ii) The petitioner will produce demand draft of 30,000/- in the name of the informant in Court below and, thereafter, his bail bond shall be accepted. The Court below will call the informant and handover the demand draft to the informant.
