Petitioner prays for bail in connection with Forbesganj P.S.Case No. 43 of 2018, corresponding to G.R.No. 184 of 2018, registered for the offence punishable under Section 392 of the Indian Penal Code.

Petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused and he has also made his confession and further he is accused in five other cases also.

Submission of learned counsel for the petitioner is that in except confessional statement there is nothing against him and there is no recovery from his possession and he is in custody since 26.1.2018.

Patna High Court Cr.Misc. No.47181 of 2018 (3) dt.20-09-2018 2/2 Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case and trial commenced, learned trial court shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
