JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Bhabhua P.S. Case No. 293 of 2017, disclosing offence under Sections 420, 467, 468, 471 and 34 of Indian Penal Code.

As per prosecution case, the petitioner showing his mother dead and sold her share to some other persons. As per learned counsel for the petitioner submitted that the informant is not his mother and for that he has filed a title suit also and moreover, his mother is entitled for half of the share and she has also sold her share.

Heard learned A.P.P. also and perused the impugned order from which it appears that the land mentioned in the sale deed is probate for which probate case no. 137 of 2007 was filed

Patna High Court CR. MISC. No.70388 of 2019(2) dt.16-01-2020 2/2 by the petitioner and the same was rejected against which Misc. appeal was filed before this court and that Misc. appeal also dismissed even the matter went up to the Hon'ble Supreme Court and the same was dismissed by the Hon'ble Supreme Court.

Having heard both sides, in view of the submissions made above as well as materials available on the records, I am not inclined to grant privilege of anticipatory bail to the petitioner.
