JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Dr. Manoj Kumar, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 19-07-2017 in Kahalgaon (Shiv Narayanpur) P.S. Case No. 388 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that in the present case, total recovery of about 22 liters of country-made liquor was shown, which was not recovered from conscious possession of the petitioners. Learned counsel for petitioners has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioners are having

Considering the nature of accusation, clean antecedent and period of custody, let both petitioners namely Rajesh Hembram and Daroga Tudu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhagalpur in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No. 388 of 2017.
