The petitioner seeks regular bail in connection with S.T. No. 707 of 2017 arising out of Karja P.S. Case No. 11 of 2017 registered for offences punishable under Sections 395 and 397 of the Indian Penal Code.

Allegation against the petitioner is that petitioner is not named in the FIR. His name has transpired during the course of investigation.

Submission of the learned counsel for the petitioner is that except confessional statement, nothing is found against the petitioner. Petitioner is languishing in judicial custody since 11.05.2017. Other co-accused has already been granted privilege of bail vide order dated 28.06.2018 passed in Cr. Misc. No.36361

Patna High Court Cr.Misc. No.45559 of 2018 (3) dt.10-09-2018 2/2 of 2018 Heard learned A.P.P. also who have opposed the prayer for bail on the ground that accused is involved in other cases. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned 13th Addl. Sessions Judge, Muzaffarpur in connection with S.T. No. 707 of 2017 arising out of Sakra P.S. Case No. 11 of 2017, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
