JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2018 The petitioner seeks regular bail in connection with Karakat P.S. Case No. 256 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 120B. 504 and 506 of the Indian Penal Code.

Allegation against as per F.I.R is that petitioner assaulted the deceased by means of brick and co-accused persons assaulted him by means of iron rod on his head causing his death. It has been submitted on behalf of the petitioner that only allegation against the petitioner that he assaulted the deceased by means of bricks on his eye and the specific allegation against other co-accused persons of assaulting the deceased by means of iron rod on the head of the deceased and the post mortem report also shows only one injury on the head of the deceased and further

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail and submitted that planned murder of the deceased by the accused persons. Considering the aforementioned facts and circumstances, this application is disposed of with direction to the learned court below to release the petitioner to his own satisfaction, once charge is framed in this case with condition that petitioner shall cooperate in disposal of trial.
