The petitioners is apprehending his arrest in a case registered for the offence punishable under Sections 341,323,324,307,427,380,354(B),504 of the IPC. Allegation as per FIR is that due to quarrel between the children, on 6.7.2019, all the accused persons started abusing and assaulting the informant and his family members with fists, slaps and dabia and caused injury. Accused Babu caused injury on the head of informant with dabia with intent to kill him and accused Mansoor assaulted the informant with fists and slaps. Accused Babli and Sahnaz assaulted the wife, daughters and mother of informant with
Patna High Court CR. MISC. No.73645 of 2019(2) dt.21-11-2019 2/2 fists, slaps and kicks and after entering into the house of informant damaged the articles kept in the house and accused Babu took out cash of Rs.12,000/- from the atache and tore the clothes of the daughter and wife of informant. The injured persons were treated in hospital.
Learned counsel for the petitioners submits that they have been falsely implicated in this case due to previous enmity. He further submits that there is case and counter case between the parties. Learned counsel for the petitioners further submits that allegation is general and omnibus and injuries and simple in nature. In the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Araria (R.S.) P.S. Case No.546/2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) Prakash Narayan /- U T
