JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner, the informant and the learned A.P.P. for the State.

The petitioner seeks bail in Laheriasarai P.S. Case No. 54/2018, instituted for the offences under Sections 401, 411, 414, 379, 420 and 34 of the Indian Penal Code.

In the written report, it is alleged that on getting information that some persons were engaged in the business of committing theft of motorcycle, the police party conducted raid in the house of Raja @ Hanuman. Seeing the police party, some persons started running away but one person namely Anubhav Kumar Jha was arrested with a motorcycle. He did not produce any paper with regard to motorcycle. On the basis of confession of Anubhav Kumar Jha, raid was conducted in the house of various

Patna High Court Cr.Misc. No.53227 of 2018 (3) dt.27-09-2018 2/2 persons and several motorcycles were recovered. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has come on the basis of confessional statement of Anubhav Kumar Jha. It is further submitted that during course of investigation Meraj and Akbar have confessed before the police and disclosed the name of this petitioner. The motorcycle was recovered from the gate of the house of this petitioner but there was no claimant of aforesaid motorcycle.

The petitioner is in custody since 08.04.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 54/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
