The petitioner seeks bail in connection with Madhepura P.S. Case No. 430 of 2017 dated 27.06.2017 instituted for the offences under Sections 147, 149, 341, 323, 307, 337, 379, 385, 386, 504, 506 of the Indian Penal Code.

The petitioner, who has been referred to as sonin-law of co-accused Sushil Kumar Yadav, has been alleged to have dragged the informant and assaulted him along with other named accused persons. The informant/victim has stated that Rs. 25000/- was demanded from him as protection money for carrying on the construction activity and he was also divested of Rs. 10,000/- which he was in possession of at the time of the occurrence.

No.44012 of 2017 (3) dt.08-12-2017 2/2 Learned counsel for the petitioner has submitted that no specific allegation has been levelled against the petitioner and he has only been named in the F.I.R. The injuries suffered by the victim are in the nature of bruises and swelling but somehow or other, those have been found to be grievous in nature by the doctor.

The petitioner is in custody since 27.06.2017 and does not bear any criminal antecedent.

Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 430 of 2017.
