2. Petitioner seeks bail who is in custody since 09.01.2021 in connection with NDPS Case No. 2 of 2021 arising out of Saraiya P.S. Case No. 20 of 2021 , F.I.R. dated 07.01.2021 for the offences punishable under Sections 414/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act and Sections 20 and 22 of the NDPS Act. .

3. Earlier the bail application of the petitioner has been rejected vide order dated 16.05.2022 passed in Cr. Misc. No. 33646 of 2021.

4. Vide order dated 01.12.2023 a report was called with regard to the criminal antecedent of the petitioner. It

No.76728 of 2023(3) dt.05-01-2024 2/2 appears from the paragraph no. 3 of the bail petition that the petitioner carries two criminal antecedents other than the present one but the report suggests that the petitioner has been implicated in five cases other than the present one.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid fact that the petitioner has concealed his criminal antecedent, I am not inclined to enlarge the petitioner on bail in connection with NDPS Case No. 2 of 2021 arising out of Saraiya P.S. Case No. 20 of 2021 pending in the court of learned Additional Sessions Judge-I-cum Special Judge , Muzaffarpur.

7. Prayer is refused.
