The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 365 and 34 of the IPC but the police after investigation submitted charegesheet against the petitioner under Sections 363, 365, 394, 302, 412 201 and 120B of the Indian Penal Code. The informant raised suspicion that her son had been kidnapped by this petitioner along with co-accused persons. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he has falsely been implicated in this case. It is also submitted that the name of the petitioner came into light merely on the basis of confessional

No.72582 of 2022(2) dt.20-03-2023 2/2 statement of Navneet Kumar, who has already been granted bail by a coordinate Bench of this Court vide order dated 30.03.2022 passed in Cr. Misc. No 50743 of 2021. Moreover, the petitioner is languishing in judicial custody since 16.04.2021. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shastri Nagar P.S. Case No. 57 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial A.C.J.M.,-IV, Patna.
