Petitioners apprehend their arrest in Dehri Nagar P.S. Case No.428 of 2019 registered under Sections 147, 149, 379, 341, 353, 411, 427, 504 and 506 of the Indian Penal Code. The gist of the allegation is that the informant got information that the tractor drivers had come for illegal mining and transportation of sand and when the informant reached there, he saw many tractor drivers had assembled on the road and they started protesting.

Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. The name of petitioners surfaced in the case on the basis of recovery of the tractors.

Patna High Court CR. MISC. No.68517 of 2019(2) dt.14-11-2019 2/2 Petitioner no.1 is the owner and petitioner no.2 is the driver of one of the tractors seized. It is further submitted that they got valid license for transportation of sand but their tractors have illegally been seized.

Having considered the facts and the nature of allegation made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, Rohtas in connection with Dehri Nagar P.S. Case No.428 of 2019 (G.R. No.720 of 2019), subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
