Petitioners seek bail in a case registered under Sections 304B, 201/34 of Indian Penal Code.

Submission is that petitioners are father-in-law and mother-in-law of the victim. The informant, who is the grandfather of the victim, it is submitted, was duly informed when the victim was undergoing treatment at the Hospital. Further submission of the petitioners' counsel is that the informant had attended the victim when she was admitted at the Hospital and was also present in the cremation. It is further submitted that the said facts would be evident from the date of lodging the first

Patna High Court Cr.Misc. No.45150 of 2017 (2) dt.19-09-2017 2/2 information report which is dated 02.04.2017 that is the same date on which the victim is said to have died. The petitioners are in custody since 08.05.2017. Further case of the petitioners is that they are separate from the son that is husband of the victim. Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bikramganj, Rohtas at Sasaram in Suryapura Police Station Case No 40 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(ii) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
