Petitioner prays for bail in connection with Gopalpur P.S.Case No. 92 of 2017 registered for the offences punishable under Sections 304B, 120B and 34 of the Indian Penal Code. Allegation against the petitioner is of causing dowry death to his wife.
Submission of learned counsel for the petitioner is that there is no allegation against him of demand or cruelty and petitioner is in custody since 30.4.2018.
Heard learned APP also, who has opposed the prayer for bail stating that post mortem report shows some injuries over the person of deceased and dead body was found inside the house of the petitioner and charge sheet has been submitted under Section 302 IPC.
Patna High Court Cr.Misc. No.49666 of 2018(4) dt.29-10-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
However, learned court below is directed to expedite the commitment of the case and then learned trial court is directed to expedite the trial and conclude the same within seven months from the date of commitment.
With the above observation, this application is dismissed.
