JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khagaria P.S. Case No. 523 of 2019, registered for the offences punishable under Sections 366 (A) & 34 the Indian Penal Code.

As per F.I.R there is allegation that minor daughter of the informant was kidnapped by the son of the petitioner and others and when informant went to enquire about the same from the petitioner she abused the informant and not co-operate in tracing out the minor daughter of the informant. Submission of the learned counsel for the petitioner is that allegation of kidnapping is against son of the informant and she has been made accused only with a view to pressurize the son of the petitioner.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No.-523 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and co-operate in tracing out the victim girl.
