This application, for grant of anticipatory bail, arises out of Mushri Gharari P.S. Case No. 23/2017, disclosing offences under Sections 341, 323, 324, 325, 307/34 of the Indian Penal Code.

The petitioners are ladies. There are 13 persons named in the F.I.R. All belong to same family. Learned counsel appearing on behalf of the petitioners has submitted that there is no specific allegation of participation of these petitioners in the F.I.R. with reference to any particular overt act, though, there is such allegation against other co-accused persons.

No.46321 of 2017 (2) dt.03-10-2017 2/2 Considering the fact that the petitioners are ladies and they have been implicated with other members of the family in criminal case, arising out of land dispute, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Samastipur in connection with Mushri Gharari P.S. Case No. 23/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
