1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 115(2), 74, 109, 303(2), 352, 351(2) and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that accused persons including the petitioner came and Rajesh assaulted his sister Rupa by axe causing injury on head thereafter Hariom assaulted Rupa by knife on neck on account of which she became unconscious and Manish snatched chain of Rupa.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting Rupa is against Rajesh and Hariom while Manish is

Patna High Court CR. MISC. No.75894 of 2025(2) dt.17-12-2025 2/2 alleged to have snatched the chain but then petitioner came to be implicated merely for the reason that she is wife of brother of Rajesh and the allegation against her is general and omnibus in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that there is a specific allegation against the accused Hariom of assaulting Rupa by knife.

6. After hearing the learned counsel for the petitioner and taking into consideration the fact that petitioner is a woman and is a person with clean antecedent, let the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Jamo Bazar P.S. Case No. 139 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS. (Satyavrat Verma, J) Kundan/- U T
