JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Narhat P.S.Case No. 60 of 2018, registered for offences punishable under Sections 392 of the Indian Penal Code. Allegation as per F.I.R. is of snatching the motorcycle on the point of pistol from the informant and also snatched Rs. 600/- and key of the motorcycle and accordingly, seizure list has been prepared.
Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and later on, he was arrested and nothing has been recovered from the possession of the petitioner and he is in custody since 30.06.2018. Heard learned A.P.P. who opposes the prayer for bail.
Patna High Court Cr.Misc. No.49167 of 2018 (3) dt.01-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner, however once charge has been framed and trial commence, the petitioner shall be released to the satisfaction of the trail court on condition that he will co-operate in disposal of trial.
This application is accordingly disposed of.
