The petitioner apprehends his arrest in a case registered for the offence punishable u/s 147/148/149/323/307/337/338 of the IPC and sections 25(I)a/26/27/35 of the Arms Act. 3.

The informant, being the Inspector-cum-S.H.O. of Hisua Police Station got information that in village Latawar, an occurrence of fight and firing in between two groups has occurred and that the petitioner and others are involved in the said occurrence.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case merely on suspicion. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific

Patna High Court CR. MISC. No.76516 of 2024(2) dt.19-11-2024 2/2 rather general and omnibus in nature. No eye witness has supported the prosecution case. Petitioner has no criminal antecedent and similarly situated co-accused have been granted anticipatory bail by this Court vide order dated 18.11.2024 passed in Cr. Misc. No.76178 of 2024.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, since similarly situated co-accused have been granted bail, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of eight weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Hisua P.S. Case No.324 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. 7.

However, learned Court below is directed to verify the criminal antecedent of the petitioner, before accepting his bail bonds and if it is found that he has criminal antecedent, apart from the present case, his bail bonds shall not be accepted. (Anjani Kumar Sharan, J) pallavi/- U T
