JUSTICE BIRENDRA KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections147, 341, 323, 324, 307, 504, 354 and 379 of the Indian Penal Code.

Allegation against the petitioner is of assaulting and causing injury with sword at the head of the informant. The Doctor has found lacerated wound over parietal region of scalp simple in nature and caused by hard and blunt substance.

Considering the fact that the petitioner had knowledge that his act might cause injury, this is not a fit case for anticipatory bail. However, the prayer for

Patna High Court Cr.Misc. No.44959 of 2017 (2) dt.20-09-2017 regular bail of the petitioner, in the event of arrest or surrender within four weeks, shall be disposed of without being prejudiced by this order.
