2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 337 & 338 of the Indian Penal Code and Section 25 (1) a/26/27/35 of the Arms Act.
3. The informant, who is an Inspector-cum-S.H.O. of Hisua Police Station got information that in the village Latawar there was an occurrence of fight and firing in between two groups and petitioners are involved in the said occurrence.
4. It is submitted by learned counsel for the petitioners that no
Patna High Court CR. MISC. No.76178 of 2024(2) dt.18-11-2024 2/2 such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case merely on suspicion. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. No eye witness has supported the prosecution case. It is further submitted that informant of this case has not disclosed the source of information that the petitioners are involved in this case rather he has made accused merely on suspicion. There was firing and cross-firing as alleged by the informant. Petitioners have no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Hisua P.S. Case No.324 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Trivedi/- U T
